Preliminary Investigation Fee and Conciliation Fee

1. Preliminary investigation fee

    Yen 80,000 per case

    Where all the parties to the dispute agree to settlement of the dispute by conciliation and file a Submission for Conciliation pursuant to Section 1(2) of JSE Conciliation Rules, the fee shall be borne equally by the parties.

2. Conciliation fee

    The costs to be deposited by the parties as the remuneration for the conciliator and the administrative expenses of JSE are as follows:

Sole Conciliator

In the case where the amount of the claim is less than Yen10 mil.,

the conciliation fee is 4% of the amount of the claim, but not less than Yen120,000.

In the case where the amount of the claim is between Yen10 mil. and Yen50 mil.,

the conciliation fee is Yen400,000 plus 1% of the claim amount over Yen10 mil.

In the case where the amount of the claim is between Yen50 mil. and Yen100 mil.,

the conciliation fee is Yen800,000 plus 0.5% of the claim amount over Yen50 mil.

In the case where the amount of the claim is more than Yen100 mil.,

the conciliation fee is Yen1,050,000 plus 0.25% of the claim amount over Yen100 mil.

Two or more Conciliators

In the case where there is more than one conciliator, a further conciliation fee of 50% of the sole conciliator's conciliation fee is payable in respect of each additional conciliator.

• i) In the case where the amount of the claim is not stated at the time of initiation of the conciliation proceedings, an appropriate conciliation fee will be determined through consultation among JSE, the conciliator and the parties.
• ii) The parties shall pay consumption tax, if necessary, on both the preliminary investigation fee and the conciliation fee.
